Terms of Service

These terms govern accounts, subscriptions, payments and use of Sohobyte AI.

1. Agreement

These Terms of Service govern access to Sohobyte AI. By creating an account, starting a trial, purchasing a subscription or using the service, you agree to these Terms on behalf of yourself or the organisation you represent.

You confirm that you are at least 18 years old and have legal authority to enter into this agreement.

2. The service

Sohobyte AI provides website assistants, AI-generated responses, analytics, business insights, configuration tools and related services.

Features, limits and availability may differ by plan. Enterprise services may be governed by a separate proposal, order form or contract.

3. Accounts

  • You must provide accurate information and keep it current.
  • You are responsible for your account, users, credentials and workspace activity.
  • You must notify us promptly if you suspect unauthorised access.
  • You may not share access in a way that avoids applicable user or plan limits.

4. Trials and subscriptions

Eligible customers may receive a limited trial. Trial duration and included usage are displayed when signing up.

Paid subscriptions renew automatically at the applicable monthly or annual interval until cancelled. Prices and billing currency are shown before checkout.

Subscriptions are processed through Stripe. Taxes may be added where required by law.

5. Cancellation

You may cancel a paid subscription through the billing portal. Unless otherwise required by law, cancellation takes effect at the end of the current paid billing period and access to paid features continues until that date.

Deleting an account does not automatically cancel an active Stripe subscription unless the service expressly confirms otherwise.

6. Customer content

You retain ownership of content, business information and materials submitted to Sohobyte AI.

You grant Sohobyte a limited licence to host, copy, process and transmit that content only as necessary to provide, secure and improve the service.

You are responsible for ensuring that your content, website and collection of visitor information comply with applicable law.

7. AI outputs

AI-generated responses may occasionally be incomplete, inaccurate or inappropriate. You are responsible for reviewing configuration, knowledge and outputs before relying on them for legal, medical, financial, safety-critical or similarly high-risk purposes.

Sohobyte AI must not be used as the sole source of professional advice or emergency support.

8. Acceptable use

You must comply with the Acceptable Use Policy. We may suspend or restrict use that threatens security, causes material harm, breaches law or risks the service or other customers.

9. Intellectual property

Sohobyte Ltd retains all rights in the service, software, branding, documentation, designs and technology, excluding customer content and third-party materials.

These Terms do not grant you ownership of Sohobyte software or the right to copy, resell, reverse engineer or commercially exploit it except where expressly permitted.

10. Service changes and availability

We may improve, modify or discontinue features. We aim to provide a reliable service but do not guarantee uninterrupted or error-free availability.

Scheduled maintenance, provider outages, security incidents and events outside our reasonable control may affect availability.

11. Warranties and liability

The service is provided with reasonable care and skill. To the fullest extent permitted by law, other implied warranties are excluded.

Sohobyte Ltd is not liable for indirect, consequential or special loss, loss of profits, loss of opportunity, or loss resulting from customer configuration, unlawful content, third-party services or reliance on AI output.

Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence.

12. Suspension and termination

We may suspend or terminate access for material breach, non-payment, security risk, unlawful use or conduct that threatens the service.

On termination, rights to use the service end. Provisions intended to survive termination, including payment, confidentiality, intellectual property and liability terms, remain effective.

13. Governing law

These Terms are governed by the laws of England and Wales. The courts of England and Wales have jurisdiction, subject to any mandatory rights that apply to a consumer in their country of residence.
